The court assumed that at the time that the lease was prepared the parties were deemed to be men of commercial substance and alive to the ways of landlords and tenants.

The judge found that the clause meant that at each review period the tenant shall pay the higher of either the base rent or the current value. The landlord was in effect ordered to have a review.
