ABSTRACT

A party may be dissatisfied with own appointed surveyor and make a third surveyor application as a means of resolving an otherwise difficult state of affairs. Most such applications are made by surveyors. Surveyors contemplating an application should bear in mind that the third surveyor will award his own fees against one or more of the parties. Occasions do arise where surveyors behave unprofessionally and lack the detachment required of them. Where possible, a joint or agreed letter to the third surveyor will help to clarify points which might otherwise emerge only slowly and painfully. One advantage of the third surveyor system of resolving disputes is that it is usually inexpensive as compared with other methods of resolving disputes. One or more of the parties and/or the surveyors may apply to the third surveyor if they have a dispute which they are unable to resolve.
