The Case of the Missing Landlord
Without a traceable landlord there is no one legally responsible for the maintenance, repair, insurance or management of a block of flats. Only a landlord can lawfully act to prevent trespass by third parties on the communal areas of leased premises, such as a car park. Only a landlord can enforce payment of service charges and ensure compliance with other leasehold obligations. It is therefore not surprising that
mortgage lenders will require new purchasers of flats and maisonettes to take out title indemnity insurance where a landlord cannot be traced.
