ABSTRACT

This chapter examines why wayleave payments are made, who the beneficiaries of the wayleave payments are and the calculation of payment values and the basis of making payments under wayleaves. Express non-statutory wayleaves granted by landowners and/or occupiers provide for payments to be made in return for the electricity apparatus on their land. Such wayleaves set out what the payment will be, how it will be calculated and the period covered by the wayleave payment. In comparison to electricity wayleave payments, relatively generous payment levels were offered where fibre optic cables could be attached to electric lines. The date the Secretary of State grants the necessary wayleave provides the date of valuation and interest will be payable on the amount assessed in accordance with the Acquisition of Land Regulations 1995. Wayleave compensation comprises two elements divided between landowners and occupiers, owner/occupiers receive both payments.
