ABSTRACT

This chapter explains the procedures embedded in schedule 4 to the Act. The Secretary of State' s jurisdiction has been remitted to the Secretary of State for Trade and Industry and so is exercised via the Department of Trade and Industry (DIT). The procedures relating to necessary wayleaves embedded in schedule 4 to the Act have been supplemented by guidance issued by the Department of Trade and Industry. The ability to survey such land, in order to appraise its suitability for an electric line, may also fall within the definition of buildings where the licence-holder would be unable to rely on their statutory rights of entry. There is specific provision that where the survey is to be carried out on land held by statutory undertakers, who would also be served with notice, and they object to the works then the work could only commence with the consent of the Secretary of State.
