ABSTRACT

Normative influences operate in the jury room as a direct result of internal group dynamics. But there may be added pressures from both inside and outside the courtroom. Although juries deliberate in complete secrecy their verdicts are a matter of public record and are watched closely by others. There are two sources of outside normative influence on the jury: (a) external from the news media interested nonparties and the community they are called on to represent and (b) court-generated emanating from the judge. In order to guard the delicate balance between informational and normative pressure juries should be protected from unacceptable levels of intimidation from both sources. 1 The question is how?
