ABSTRACT

Conflicts between host governments and foreign investors arise from: (1) opposing objectives in the negotiation of a mine development agree ment; (2) the interpretation of the agreement after it is negotiated; (3) alleged violations of the agreement; and (4) demands for renegotiation of the agreement or its denunciation by one of the parties. In this chapter we are mainly concerned with the resolution of opposing objectives in the negotiation of agreements, not only as a means of promoting the consummation of the agreements themselves, but also for building conditions into the agreement that will minimize conflicts and facilitate the settlement of disputes during the tenure of the agreements. 1
