ABSTRACT

Staff often have concerns regarding their obligation to administer medicines in school. The following advice is given by the DfEE/DH:

“Employers (usually the LEA or governing body) should ensure that their insurance policies provide appropriate cover for staff willing to support pupils with medical needs.” para. 13

“Subject to this point, there is no legal or contractual duty on staff to administer medicine or supervise a pupil taking it. This is a voluntary role. Support staff may have specific duties to provide medical assistance as part of their contract.” para. 13

“Teachers and other school staff have a common law duty to act as any reasonably prudent parent would to make sure pupils are healthy and safe on school premises and this might in exceptional circumstances extend to administering medicine and/or taking action in an emergency.” para. 14
