ABSTRACT
This chapter aims to prohibit the importation of hazardous wastes into Pacific Island developing Parties, and to regulate and facilitate the environmentally sound management of such wastes generated within the Convention area. It explores the importation of all radioactive wastes into Pacific Island developing Parties while at the same time recognizing that the standards, procedures, and authorities responsible for the environmentally sound management of radioactive wastes will differ from those in respect of hazardous wastes. The chapter shows that any transboundary movements of hazardous wastes within the Convention area are completed in a controlled and environmentally sound manner. Annexes contain detailed operational obligations on categories of wastes which are hazardous wastes, a list of hazardous characteristics, disposal operations, notification procedures, and arbitration. Each other Party shall take similar measures within the area under its jurisdiction to ban the export of all hazardous wastes and radioactive wastes to all Forum Island countries, or to territories located in the Convention area.
