ABSTRACT

The second part of this book deals with complaints about SEN provision for individual children. There are four different statutory complaints mechanisms. They are complaint to the Secretary of State, complaint to the Local Government Ombudsman, appeal to the SEN Tribunal and application to the High Court. The formal complaints procedures are described in the next four chapters. The selection of the appropriate complaint mechanism is not always straightforward. In the case of complaint to the Secretary of State and complaint to the Local Government Ombudsman, making the complaint is easy but the resolution of the complaint may take between one and two years. Appeal to the SEN Tribunal and application to the High Court require a considerable amount of work by or on behalf of the parent.
