ABSTRACT

It is the author's opinion that the redevelopment act, is considered in the light of all the reasons and authorities is unconstitutional. His study of this act has convinced him beyond a reasonable doubt that it authorizes the taking of private property for the express purpose of an ultimate private use. At first blush it seem extravagant to attribute such transcendent importance to the simple issue presented here, but the author is confident that upon mature reflection its supreme importance becomes more and more evident. Manifestly no per capita land cost is designed to extend to the 9,000 acres in New York City that the committee's report shows has been classified as slum, which is persuasive that the project never have been undertaken for slum clearance alone. The New York City Council passed legislation withholding tax exemption from any subsequent redevelopment company unless it gave assurance that no discrimination is practiced in its rental policies.
