ABSTRACT
In conclusion, the action of the planning board was held to "bear no substantial relation to the promotion of the public health, safety, morals or general welfare of the community" Therefore, it was deemed arbitrary and unreasonable and was ordered annulled. Appellants have made it abundantly clear that respondent's projected school has many features which seriously impair the social and economic benefits to the entire community which the zoning law is designed to preserve and promote. Proceeding by Corporation of the Presiding Bishop of the Church of Jesus Christ of Latter-Day Saints, a Utah corporation sole, against the City of Porterville and others, for a writ of mandate to compel defendants to issue a permit for the construction of a church. While there may be merit in this argument, we do no, find it necessary to reach these questions, for, even if we deem the Brighton ordinance to be valid and constitutional for the purposes of this proceeding.
