ABSTRACT

In view of the governing principles stated in this opinion, and applicable here, we hold that the operation of the diner in question on the Warren premises located in a residential zone is no. prohibited by section 13 of the zoning regulations of the Village of St. Johnsbury. When subsequently "revised" permits were obtained in the name of the owner, Austin Square, Inc, there was no compliance with Zoning Code Section 1163.20, subparagraph 3, requiring submission of the development plans to the Planning Commission, no. with Section 1171.20 requiring submission of drawings to the commission. Point Pleasant Pavilion, Inc, was convicted of violating a zoning ordinance of the Borough of Point Pleasant Beach, and it appeals. So far as here pertinent this report reads: "It appears that supplementary machines, such as dryers and spinners, have customarily been permitted by the Department of Housing and Buildings subsequent to the Packer decision.
