ABSTRACT

To talk about maritime law is to talk about a mysterious scripture of the ages. When the Titanic struck the iceberg, the shock was so slight that it was scarcely perceptible to the more than 2,000 passengers. The boat's stern lifted in the air and there was a tremendous explosion. After this, the Titanic dropped back again. The awful screaming continued. Two minutes after this there was another great explosion. The whole forward of the great liner dropped down under the waves. The district court entered an injunction enjoining any person in the world having notice of the order, actual or otherwise, from visiting the site or photographing the Titanic. The court's custody or possession of the property may be actual or constructive. Constructive possession connotes something less than physical seizure. The court then considered separately the power of the district court and the rules applicable for exercise of that power.
