P o l i t i c i a n s a n d acad e m i c s a l i k e a r e n o w p r e o c c u p i e d w i t h aw i d e r a n g e o f q u e s t i o n s a b o u t t h e p o s s i b l e r e s p o n s e s o f d e m o c r a t i c r e g i m e s t o v i o l e n t c h a l l e n g e s . Yet, p r i o r t o a l Q a e d a ' s a t t a c k s i n N e w York, W a s h i n g t o n , a n d P e n n - s y l v a n i a , v i o l e n t c r i s e s a n d e m e r g e n c i e s a n d t h e i r i m p l i c a t i o n s f o r l e g a l s y s t e m s h a d n o t a t t r a c t e d m u c h a t t e n t i o n i n l e g a l s c h o l a r s h i p . N o r h a d t h e s i t u a t i o n b e e n m u c h d i f f e r e n t i n o t h e r c o u n t r i e s . E m e r g e n c i e s h a v e b e e n c o n c e p t u a l i z e d as a b e r r a t i o n s , r a r e a n d u n i n t e r e s t i n g e x c e p t i o n s t o t h e o t h e r w i s e o r d i n a r y s t a t e o f a f f a i r s . As F r e d e r i c k S c h a u e r s u g g e s t s i n a n o t h e r , y e t r e l a t e d , c o n t e x t , t h e e x c e p t i o n h a s b e e n " a n i n v i s i b l e t o p i c i n l e g a l t h e o r y . However, a u t h o r i t a r i a n r e g i m e s a r e n o t f a c e d w i t h t h e t r a g i c c h o i c e s t h a t v i o l e n t e m e r g e n c i e s p r e s e n t t o d e m o c r a c i e s . F o r t h e form e r , t h e o n l y s i g n i f i c a n t p a r a m e t e r s b y w h i c h t o e v a l u a t e t h e s t a t e ' s r e s p o n s e t o t h e v i o l e n c e a r e e f f i c i e n c y , a l l o c a t i o n o f r e s o u r c e s , a n d t h e p o l i t i c a l a n d p e r h a p s p h y s i c a l s u r v i v a l o f t h e r e g i m e . No r e a l t e n s i o n e x i s t s , n o r c a n o n e e x i s t , b e t w e e n l i b e r t y a n d s e c u r i t y , b e c a u s e s e c u r i t y is e v e r y t h i n g a n d l i b e r t y d o e s n o t c o u n t f o r m u c h , i f a t a l l . S u c h a u - t h o r i t a r i a n r e g i m e s a r e m o t i v a t e d b y r e a s o n o f s t a t e a r g u m e n t s t h a t a r e r e m i n i s c e n t o f t h o s e p u t f o r w a r d b y p o l i t i c a l r e a l i s t s .
