ABSTRACT

A charterparty is the contract, a private contract between two principal parties, individual or corporate. Like any other contract only those who entered into it can sue or be sued upon it. Charterparties fall basically into three categories—demise, time and voyage. Charterparty contracts which go under the trip Charters are a 'hybrid'. Being on a time form and remuneration being by way of a daily rate of hire, they logically fall within the broader genus of time charterparties. Voyage Charterparties are contracts under which a vessel is to load at one or more named ports a particular specified cargo to be carried to a named discharging port or ports. It is convenient to think of the overall performance of obligations under a voyage charter as being divided into four stages: the approach voyage; the loading process; the carrying voyage; and the discharge process.
