ABSTRACT
THE i n s t i t u t i o n o f a r b i t r a t i o n , o n o n e view, d e r i v e s its f o r c e f r o m t h e a g r e e m e n t o f t h e p a r t i e s ; o n a n o t h e r view, from t h e S t a t e as s u p e r v i s o r and e n f o r c e r o f t h e legal p r o c e s s . T h e c o n t r a c t u a l o b l i g a t i o n o f b o t h p a r t i e s e n a b l e s t h e s e t t l e m e n t p r o c e s s t o o v e r r i d e n a t i o n a l d i f f e r e n c e s in law a n d p r o c e d u r a l o b s t a c l e s which exist in local c o u r t s . I w a n t t o e x a m i n e w h a t o b l i g a t i o n s a r e i n v o k e d in t h e u n d e r t a k i n g t o a r b i t r a t e a n d t o s e e if t h e c o n t e n t o f t h e s e o b l i g a t i o n s is t h e s a m e f o r t h e S t a t e as p a r t y t o i n t e r n a t i o n a l a r b i t r a t i o n ( w h e t h e r i n t e r - S t a t e o r c o m - m e r c i a l ) as f o r t h e p r i v a t e p a r t y t o c o m m e r c i a l a r b i t r a t i o n . F o r t h e p u r - p o s e s o f t h e d i s c u s s i o n t h e t e r m S t a t e is l i m i t e d t o t h e S t a t e as ad i r e c t p a r t y a n d e x c l u d e s s e p a r a t e l y i n c o r p o r a t e d S t a t e - t r a d i n g e n t i t i e s . S e c o n d , t h e e x t e n t t o which aS t a t e ' s c o n s e n t t o a r b i t r a t e h a s b i n d i n g e f f e c t o n c l a i m s o f its n a t i o n a l s s u b m i t t e d by t h e S t a t e t o i n t e r - S t a t e a r b i t r a t i o n . F i r s t , h o w e v e r , it is u s e f u l t o c o n s i d e r in ag e n e r a l way t h e e x p e c - t a t i o n s o f S t a t e s c o n c e r n i n g a r b i t r a t i o n b a s e d o n t h e i r use o f t h e p r o c e s s o v e r t h e last 50 y e a r s .
