ABSTRACT

M. E. Kibbe, Administratrix, vs. Berkshire Life Insurance Company. – This case, which was recently tried in the Supreme J. Court at Boston, before Chief Justice Bigelow, 1 was a suit to recover the amount of a policy of insurance issued by the defendants, the Berkshire Life Insurance Company, on the life of one P. M. Kibbe, deceased. The defense was that the assured, in the application upon which the policy was issued, falsely stated that he had never been afflicted with spitting of blood, whereas he had had a severe hemorrhage of the lungs only six months previous to making the application.
