ABSTRACT

This chapter presents the case study of Nick. The events that Nick recounts are the climax of a period of disruption in his life. Nick had experienced months of abuse. The story Nick describes illustrates the particular needs he may have had in police custody; ones that were not met through the support provided to him. Being arrested was a huge disruption to Nick's life, at a time when he was already finding it difficult to manage what was happening around him. Police custody was wholly unsuited to Nick's needs. Although Nick was supported by an Appropriate Adult during his police interview it is unclear that this was an effective way of supporting Nick to make decisions during the custody process. Nick's story demonstrates that solutions to violations of Article 14 may have their origins in Article 12, recognising the legal capacity of all disabled people.
