ABSTRACT

The coming into force of the Rome Statute has institutionalised putting an end to impunity gap. In achieving the goal of ending impunity, the Rome Statute has placed the primary duty of investigation and prosecution of crimes recognised under the Rome Statute in the hands of state parties. The primary duty of states to prosecute and investigate crimes recognised under the statute is what is known as the principle of complementarity and it is embedded in articles 1 and 17 of the Rome Statute. Since Nigeria is a party to the Rome Statute, it is also expected to investigate and prosecute crimes recognised under the statute.
