ABSTRACT

Non-transparent economic interests may influence legislation, its implementation, competition in the market and finally economic growth and competitiveness. It may underpin corrupt behaviours and result in the creation of a kind of barrier in the market: new borders and constraints within the economy. This effect is particularly evident in public procurement and the renegotiation of the contract. The lack of integrity and corruption affects human rights and the market, and are an issue in public procurement. The most common definition of corruption is the one used by the Transparency International NGO, according to which corruption is the "abuse of entrusted power for private gain". Corruption impacts societies in a multitude of ways and has an important human rights dimension. Under the French law, corruption and conflicts of interest have many legal qualifications: active and passive corruption, influence peddling and conflicts of interest.
