ABSTRACT

This chapter mainly presents the function of procedure in theory and elements such as, functional requirements related to general structure. Procedure begins with application and ends with decision, the process of which contains conditions, methods, steps, and ceremonies. Participants of procedural activities are separated from the real world's causal chain. Modern procedure upholds the four cardinal principles: due process, neutrality, conditional advantages, and rationality. According to the usual classification method, legal procedure mainly includes legislation, judicature, and administration. Elections are political activities, but in modern times, it has become an important form of legal procedure. Mediation is the most typical informal means to resolving disputes, with the appearance of being anti-procedural. If our legal education and judicial institutions are reformed extensively in accordance with legal professionalism, rapid growth can be expected in the formal rationalization of our legal system.
