ABSTRACT

Where law is simply an expedient for the settlement of disputes or the accommodation of conflicting interests, the work of the lawyer involves little more than the mastery of some techniques of social adjustment. A modern market economy requires not only free competition but also reasonable institutions, where the establishment of a new power structure that can ensure a fair distribution of resources and a democratic legal system is essential. Professional lawyers enjoy a crucial status in developed countries, not only for their cognizance of law but also more importantly for the unique mode of thinking they obtained from education and the practice of law that satisfy demand for time. During the period of Taika Reform, the political system from the Tang Dynasty was implemented in Japan; on that basis, the traditional legal culture, similar to that of imperial China, gradually took shape.
