ABSTRACT

Most Supreme Court judgments regarding the constitutionality of environmental protection laws have upheld the laws based on the "interstate commerce" clause, which states that Congress has the power to "regulate Commerce with foreign nations, and among the several States, and with Indian Tribes". No happiness without liberty, no liberty without self-government, no self-government without constitutionalism, no constitutionalism without morality—and none of these great goods without stability and order. Scientific information or analyses have no constitutionally defined role in government. Science or scientists have no constitutionally guaranteed and protected seat or role in government. Much of the growth of the bureaucracy has been based on the perception of Congress that science is good and leads to solutions for many of our current social problems. Thus, many of the bureaucrats are scientists and engineers whose jobs are to discover and document physical facts.
