ABSTRACT

One of the difficulties in formulating a model ordinance concerns the variation in the specific public entities charged with administering land use regulations in different states and attendant varying administrative procedures. The administration and procedure provisions in the model ordinance are therefore abbreviated. In the spirit of reducing unnecessary administrative responsibilities by the planning board and the zoning board of adjustment, provision is made for exempting certain types of development from site plan review where such action is deemed unnecessary. Similarly, to avoid duplicative review, provision is made for the planning board and zoning board of adjustment to act independently as opposed to requiring sequential action by both boards. The waiver and exception provisions are added to avoid unnecessary review by the planning board and zoning board of adjustment and unnecessary expense by the developer. The chairperson of the planning board may appoint a subdivision and site plan committee.
