ABSTRACT

Democratic government is government by the people. The democratic character of a political system is measured by three tests: How much of the population shares; in how much of the crucial decision-making; with how much impact. In a democratic system, everybody counts; government is run for the benefit of all the population. There is no way of knowing what is good for the people, what the people ought to have. The unregulated political activity saves democratic government from a pallid mediocrity and rescues an outvoted minority from a decision that presses too hard. Felix Frankfurter, speaking from the bench, called the Supreme Court "the non-democratic organ of our Government" and added that "the powers exercised by this Court are inherently oligarchic". The Supreme Court of the United States compels the living generation, too often swept by selfish interests and frenzied passions, to respect the immutable principles of liberty and justice.
