ABSTRACT

This chapter describes the main elements of the new Hungarian law. Regulation on Assisted Procreation in Hungary has two levels at the moment: a chapter in the Parliamentary Act on health care and the Ministry decree. The 1997 Health Act includes a chapter on assisted procreation providing main rules for access and the condition for the different forms of assisted procreation. The Ministry decree encompasses extraordinary procedures of human reproduction, the treatment of embryos, gametes and their storage. The Hungarian reproductive regulations which took into the consideration the lessons drawn from the 1990 British Act, the 1994 French Act and American jurisprudence could be regarded as a good attempt towards transparency. The 1998 Ministerial decree specified the medical indication of each of the medically assisted procreation (MAP) procedures. Before starting the medical interventions the doctor has to provide full information about the MAP for the couple, both in written and in a verbal form.
