ABSTRACT

This chapter examines the Unidroit Convention on International Financial Leasing and the Convention on International Interests in Mobile Equipment. The Cape Town Convention and the Protocol remain open to signature until they enter into force. The Unidroit Convention on International Financial Leasing was opened to signature at the conclusion of a diplomatic Conference held in Ottawa in 1988. In Sweden the Parliamentary Commission on Leasing in its final report recommended not only that Sweden accede to the Unidroit Convention but also that it be taken as a model for the drafting of domestic Swedish legislation on leasing. Leasing's popularity has led to the steady spread of leasing throughout the different parts of the world in the intervening years. Unidroit's decision to embark on the preparation of uniform rules on leasing sprang from two not entirely unrelated factors, the one economic, the other legal. The Unidroit Convention's application is also extended to leveraged leasing transactions, by virtue of Article 14.
