ABSTRACT

The Bailiwick of Guernsey mainly comprises the islands of Guernsey, Alderney, Sark, Herm, Brecqhou and Jethou. The courts of Guernsey will to a large extent enforce the judgments of the limited number of countries whose courts reciprocally enforce the judgments of Guernsey, whether or not the country concerned is a Commonwealth country. The enforcement of foreign judgments in Guernsey is governed by the following principal legislation: The Judgments Law 1957; The Judgments Law 1994; The Judgments Rules 1972; The Judgments Rules 1975; and so on. The procedure for enforcement is contained in the 1972 Rules, which were made under Section 5 of the 1957 Law. In order for the judgment to be enforced in Guernsey, it must be registered in the Royal Court of Guernsey. To be registrable, it is necessary for the judgment to be for a definite sum of money and to be final and conclusive.
