ABSTRACT

This chapter argues that the power imbalance issue be addressed straight-forwardly. It also argues that the essential values and characteristics of mediation make it a particularly effective means of dispute resolution in situations where power imbalances play a role. The chapter suggests that guidelines to help the mediator make the determination without improperly usurping the rights of the disputants to reach their own settlement. It discusses each dispute resolution center to recognize and define the problem, and to establish policies and procedures for dealing with it. The mediation process is impartial. Mediation provides a nonjudgmental forum for the airing and settling of disputes. Mediation is an empowering option that should be available to as many people as possible. The mediator should trust the parties to make the decision about how much power they have, how much they want, and how much they are willing to use in a particular situation.
