ABSTRACT

This chapter discusses two fan creations—fan fiction and "let's play" videos—that particularly implicate questions of permissible and fair uses. Fans also love games long after they have commercial value and the companies that made them are marketing them. The chapter examines the legal questions that arise when fans want to play these old games on new platforms not authorized by the copyright holder. It explores the latest issues of doxing and swatting, wherein fans get carried away and their real-world actions bring criminal laws to bear. The chapter looks at questions that have been raised regarding the use of fan labor. One issue that is arising is the concept of fan labor and whether allowing fans to create new mods, 'Let's Play' videos that serve as advertising for the game, and other derivative works is, in fact, exploitative. Right-of-publicity issues are affecting fans.
