ABSTRACT

In August 1973, the Taft-Hartley Act was amended to extend coverage to employees in the nonprofit health care sector. Health care employees in several types of institutions who have religious conscientious objections are exempted from joining and financially supporting a labor organization. Payment of dues and fees is not a condition of employment, but nonunion employees may be required, by contract, to tender such amount to one of three nonreligious charities listed in the agreement. If the agreement does not specify such charitable funds, the employee and the union may mutually agree upon a suitable charity to which payment will be made. Such is the model set forth in the national labor law.
