ABSTRACT

Ideally, if there is an allegation that a criminal offence has taken place, the questioning of suspected persons should be left to the police. However, if it has been decided by management that the allegation is to be dealt with internally, this does not diminish the rights of the suspect to seek legal advice or to have someone present during an interview. Any interview conducted with a suspect must take place within parameters set by the Police and Criminal Evidence Act 1984 (PACE).
