ABSTRACT
The rationale for this and the following chapter is interconnected. In essence, the purpose of these chapters is to develop an appropriate conceptual framework against which those procedural rules of the ad hoc tribunals and the ICC that concern sentencing can be interpreted and evaluated. The following chapter utilises the same approach, but extends the analysis to consider the wider social context within which these rules and procedures operate and the implications for internationalisation in sentencing.
