ABSTRACT

In the year 2000, the American Bar Association (ABA), through its Air and Space Law Forum Special Committee on Cross-Border Investment and Right of Establishment in the International Airline Industry, raised a series of pertinent issues 'in determining whether there should be any change in US laws on foreign investments in the airline industry and whether it is feasible to work towards a common international standard on cross-border investments.' I As most of the issues raised by the ABA are not only related to the US airline industry, but also concern the entire international airline industry, the issues will be surveyed in the following analysis.2
