ABSTRACT

In Ireland, planning authorities can recoup part of the cost of public infrastructure from the private developer by attaching development contribution conditions to a pl anning permission for development. Such costs may relate to both infrastructure that has been built or that wil l be built in the future. I n practice, there is significant scope for negotiation between the planning authority and the developer in assessing the amount of the development contributions. This can be for example in relation to the works that are considered to be of benefit to the development, the estimated costs of those works, the degree to which the developer provides infrastructure, and the scope for arrangements that are of mutual benefit, such as land exchanges.
