ABSTRACT
This Chapter will examine Gender Injustice in Canada, Mexico and the United States. It will initially look at the role of women in society. It will then examine legislation impacting women, namely the Constitution as well as other important legislation. Finally, in order to properly analyze the laws and the courts, cases will be reviewed not for their factual content or the judgment issued, but more importantly for the burden of proof required in gender discrimination as opposed to racial discrimination.
