ABSTRACT

Inthischapter,wediscusstherelationshipbetweenmoralrightsandtheinstitution ofthepolice.1Wearguethattheprotectionofmoralrightsisthecentralandmost importantmoralpurposeofpolicework,albeitapurposewhosepursuitoughttobe constrainedbythelaw.Sowhilepoliceinstitutionshaveotherimportantpurposes thatmightnotdirectlyinvolvetheprotectionofmoralrights,suchastoenforce trafficlawsortoenforcetheadjudicationsofcourtsinrelationtodisputesbetween citizens,orindeedthemselvestosettledisputesbetweencitizensonthestreets,or toensuregoodordermoregenerally,theseturnouttobepurposesderivedfromthe morefundamentalpurposeofprotectingmoralrights,ortheyturnouttobe(nonderivative)secondarypurposes.Thuslawsagainstspeedingderiveinpartfromthe moralrighttolife,andtherestoringoforderatafootballmatchultimatelyinlarge partderivesfrommoralrightstotheprotectionofpersonsandofproperty.Onthe otherhand,serviceofsummonsestoassistthecourtsispresumablyasecondary purposeofpolicing.2
