ABSTRACT

The purpose of this chapter is to provide an introduction to works contract formats, language and processes, and to outline the steps that can be taken by client organisations to assist the management of the works contract strategy and tendering process. It achieves this by presenting basic facts relating to works contracts in a way that assumes no previous knowledge. The emphasis is on providing clarity through an understanding of fundamental principles, using an inclusive approach, rather than giving exhaustive detailed technical information. It is not intended to create contracts managers/administrators but to permit informed client input to the works contract process. Underlying the chapter is the belief that an appropriately structured and coordinated design development process, contract strategy, tendering process and structured tender information are inseparable and must be designed correctly if overall design direction, cost control and progress are to be maintained during the life of the project. This cannot be achieved without an understanding of the contractual process by all contributors.
