ABSTRACT

A multi-layered view of the law emphasises its historicity: the law is conceived of as a historically changing phenomenon, whose layers adhere to varying paces of change. However, the picture we have drawn of modern law in the preceding chapter does not yet capture the legal dynamics. So far we have only analysed the elements that can be discerned at the levels of the surface, the legal culture and the deep structure. This static picture is brought into motion by taking account of the relations prevailing between the levels.
