This is not the place to discuss the accuracy of Mommsen’s analysis in the context of imperial Rome, but the German historian’s use of the word may have appealed to Francesco Ercole (1879-1945) who used it in an attempt to define the legal and constitutional relationship between the communes and despots of north-eastern Italy in the late thirteenth and fourteenth centuries.
