ABSTRACT

Historical Intersectional Criminology (HIC) examines how the deliberate social construction of identity politics shapes both punishment and the perception of punishment across intersectional identities within the criminal legal system. HIC analyzes how punishment is intentionally applied based on a person’s race, socioeconomic class, gender, sexual identity and preference and additional identities, through discriminatory laws and policies. It also centers and examines resistance strategies against racialized, classed, and gendered punishment. Furthermore, this chapter explains the importance of the methodology used to study the relationship between socially constructed identities, punishment, and resistance in the criminal legal justice system.
