ABSTRACT

In this chapter, the authors provide the literature in a more descriptive fashion. Without giving an up-or-down answer on drone strike constitutionality. They explore what previous rulings may indicate about drone strikes. The authors discuss the problems presented by targeting American citizens. Nations have used remote drones since World War II, although predator drones only emerged after September 11, 2001. Drones also granted Obama the political flexibility to say he was withdrawing from the Middle East while still pursuing American interests in the region. The word imminent is particularly elastic in the White Paper as it does not require the United States to have clear evidence that a specific attack on US persons and interests will take place in the immediate future.
