ABSTRACT
The active role of a constitutional court in imposing the rule of law on politics was a revolutionary step that came with the establishment of American democracy. We can only agree with Alexis de Tocqueville that the incorporation of the judiciary into the political process was the ultimate perfection of the democratic idea and a guarantee of the preservation of a democratic constitution.
