DECISION MAKING FOR ADULTS WITH IMPAIRED CAPACITY In England and Wales the rights of adults with intellectual disability to make deci sions about their care and future are enshrined in the Mental Capacity Act 2005 (MCA). In Scotland the Adults with Incapacity (Scotland) Act 2000 covers the same issues and in Northern Ireland there are no statutory provisions.
