Although there have been a few amendments to some laws related to marriage and divorce, most laws are at least 50 years old. The understanding of mental illness has changed since then. Mental illness is not one category but many. The terms related to mental illness employed in drafting these laws are not employed for diagnosis these days. Many effective treatments are also now available. The general prognosis of mental disorders is very much better now than it was when these laws were made. So while these laws apply to the marriage contract, recent judgments of the Supreme Court of India suggest that mental illness, per se, does not disqualify one from marriage or other contracts.
