ABSTRACT
Introduction This chapter seeks to analyse the legal process involved in pursuing a claim in negligence. In the first section there is an analysis of the legal procedures involved, with review of the new Civil Procedure Rules. The second section seeks to deal with the practical aspects of handling a case and the issues that the practi tioner will embrace. The remaining sections consider other impor tant aspects, including funding, alternative dispute resolution (including mediation) and the effect of the process on those involved. It is important to note that this chapter is confined to the litigation process and does not seek to address the complaints procedure.
