The need for a medical expert We have shown earlier in this book (see Chapter 4) that for a medical negligence claim to succeed, three basic elements have to be established:
• that there was a duty of care on the part of the doctor to that patient
• that the doctor failed to meet the expected standard of care — known as liability
• that as a consequence damage has occurred to the patient - known as causation.
