To this she rep'lied that since then the marriage had been dissolved by an absolute iiecree of the Divorce Court at her suit, to which the defendant, the late husband, demurred, maintaining that it was no answer to his plea of the marriage, and that in point of law the action could not be sustained, as the assault was committed during marriage, and while the plaintiff was his wife.
