ABSTRACT

The utility of developing a pro-democracy jurisprudence turns on a fundamental question: Is democracy a desirable form of government?

It depends. Theoretically, the answer is yes, but only if citizens reside in a democratic republic,

in which majoritarian rule is constrained by the rights granted in a constitution or charter. Because a government that combines democratic and republican components intrinsically promotes basic human values, including equality, individual liberty and autonomy, self-determination, and self-governance.
